Traffic Regulation Ordinance for the City of Horn Lake, Mississippi


Whereas, the Mayor and Board of Aldermen of the City of Horn Lake, Mississippi have determined the necessity of adopting an ordinance to regulate the parking of vehicles on certain streets and highways within the City.


Whereas the Mayor and Board of Aldermen have determined that parking vehicles on certain streets with the City constitutes a hazard for other motorists. The Mayor and Board of Aldermen have determined that the hazard is due to the obstruction of oncoming traffic caused by the parked vehicle either upon the highway or street or adjacent to the highway or street in lanes designated for parking or lane designated as a paved shoulder.


Therefore, be it ordained by the Mayor and Board of Aldermen of the City of Horn Lake, Mississippi:


Section 1. Definitions

a.    Vehicle Shall mean a machine propelled by power other than human power designed to travel along the ground by use of wheels, treads, runners, or slides and transports persons or property or pulls machinery and shall include without limitation, automobiles, trucks, tractor trailers (including by not limited to 18 wheelers), motorcycles, tractors, buggies and wagons.


Section 2. Purpose

An ordinance prohibiting parking of vehicles on any street or highway or adjacent to any street or highway when official signs are present.


Section 3. Authority to place official signs

a.    Official signs, prohibiting parking of vehicles, may be posted at the direction of the Chief of Police after a determination that parking of vehicles upon or adjacent to a street or highway constitutes a hazard for other motorist.

b.    Official signs may be posted by the Mississippi Department of Transportation upon State and Federal highways within the City pursuant to a determination by the department that a need exists to prohibit parking upon or adjacent to a State or Federal Highway within the City.


Section 4. Exception to obedience to Official Signs

a.    The operator of a vehicle would not be in violation of this ordinance for parking a vehicle in an area where official signs prohibit parking if the vehicle is disabled and the driver notifies the Horn Lake Police Department of the following information:

4.    The location of the vehicle.

5.    The description of the vehicle.

6.    The name, address, and telephone number of the driver, owner or individual responsible for the vehicle.

7.    The date and time that the vehicle will be removed.


Section 5. Violations

It shall be unlawful for an operator of a vehicle to park a vehicle on or adjacent to a street or highway within the City where official signs prohibit parking.


Section 6. Penalty

Any person who violates that provisions of this ordinance shall be guilty of a misdemeanor and upon conviction shall be sentenced to pay a fine not to exceed $500.00 and/or imprisonment in the County Jail not to exceed 30 days.


Section 7. Effective Date

The Ordinance shall become effective and be in full force from and after being certified by the City Clerk, signed by the Mayor or Board Majority, recorded in the Ordinance Book, published and after waiting thirty days after passage.
