Ordinance 91-05-17

 

 

An Ordinance to Regulate Pawn Brokers and Junk Dealers in the City of Horn Lake, Mississippi

 

 

        BE IT ORDAINED BY THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF HORN LAKE, MISSISSIPPI AS FOLLOWS:

 

Section 1.   Definitions

        As used in this section, a “Secondhand Dealer” shall mean any person, firm, partnership, association, corporation, company or organization of any kind, which to any degree buys and sells secondhand articles.  It shall not apply to a private citizen who has a garage and yard sale, a nonprofit organization, or any antique dealer.

 

Section 2.   Requirements

        Every junk dealer, pawn broker and secondhand dealer in the City of Horn Lake is hereby required to make a written report to the Chief of Police of the City of Horn Lake upon forms furnished and paid for by the City of Horn Lake.  Said reports shall be made available within forty-eight (48) hours of receiving a sold or pawned article, and shall show the name, description, address, date of birth (D.O.B.) and identification number (ID) of each person selling or pawning any article, shall give a complete description, serial number and identifying marks of the sold or pawned article.

 

Section 3.   Violations of Provisions-Penalties

        Every person, firm, or corporation, their agents or employees, who shall violate any of the provisions of this ordinance, shall upon conviction thereof, be deemed guilty of a misdemeanor and may be fined a sum of not more than one thousand dollars ($1,000.00) for each offense, and at the discretion of the court, may be imprisoned for a period of time not to exceed ninety (90) days.  Upon any such conviction, the license of said brokers may be revoked.

 

        The foregoing ordinance to regulate pawnbrokers and junk dealers having been reduced to writing read and considered section by section and as a whole, and the same having been introduced by proper motion.  So ordained this the 16th day of May, 1991.
